RENTAL AGREEMENT TERMS AND CONDITIONS


1. Definitions

“Agreement” means all terms and conditions contained in this document and the Face Page.

“You” / “Your” means the renter identified in this Agreement, any person signing this Agreement, all Authorized Drivers, and any person or entity to whom charges are billed at your direction. All such persons are jointly and severally liable.

“We,” “Us,” or “Our” means Urban Rental NYC.

“Authorized Driver” means the renter and any additional driver approved and listed in this Agreement who holds a valid driver’s license and is at least 18 years old.

“Vehicle” means the automobile identified in this Agreement, including all tires, tools, accessories, equipment, keys, documents, and any replacement vehicle provided. The Vehicle may include electronic tracking devices.

“CDW” means Collision Damage Waiver.

“Physical Damage” means damage caused by collision or upset. It excludes theft, vandalism, natural disasters, or other non-collision losses.

“Loss of Use” means loss of our ability to use the Vehicle due to damage. It is calculated as:

80% of the daily rental rate × number of days the vehicle is unavailable

“Diminished Value” means the difference between the Vehicle’s value before and after damage.

“Vehicle License Cost Recovery Fee” means a daily fee to recover licensing, registration, and fleet-related costs.


2. Rental, Indemnity, and Warranties

This is a contract for rental of the Vehicle.

We may repossess the Vehicle at your expense without notice if it is abandoned or used in violation of this Agreement or applicable law.

You agree to indemnify, defend, and hold us harmless from all claims, liabilities, damages, and legal costs arising from your use of the Vehicle.

The Vehicle is provided as-is, without warranties of any kind.


3. Condition and Return of Vehicle

You must return the Vehicle:

  • On time

  • To the specified location

  • In the same condition as received (excluding normal wear)

Late returns:

  • Over 1 hour: half-day charge

  • Over 3 hours: full-day charge

You must:

  • Maintain fluid levels

  • Return with the same fuel level


4. Delivery and Concierge Services

If a concierge is dispatched:

  • 30-minute grace period applies

  • $50 charge after 30 minutes

  • Additional $50 per 30-minute delay


5. Responsibility for Damage, Loss, and Violations

You are responsible for:

  • All damage, theft, or loss (regardless of fault)

  • Repair costs or full vehicle value

  • Loss of Use

  • Diminished Value

  • Administrative costs

You must report:

  • Accidents

  • Theft

  • Vandalism

You are responsible for:

  • Tolls

  • Tickets

  • Violations

  • Towing/storage

Failure to pay results in:

  • Reimbursement obligation

  • $50 administrative fee per charge


6. Collision Damage Waiver (CDW)

If purchased, CDW reduces liability for Physical Damage.

CDW is void if damage results from:

  • Intentional acts

  • Intoxication

  • Unauthorized drivers

  • Illegal activity

  • Racing

  • Unauthorized towing

  • Driving outside approved regions


7. Insurance Requirements

You must maintain valid insurance covering:

  • Liability

  • Collision

  • Comprehensive

Accepted options:

  • Personal auto insurance

  • AMEX Premium Car Rental Protection

  • Approved third-party coverage

Proof of coverage is required.


8. Primary Insurance Responsibility

Your insurance is PRIMARY.

Our insurance (if any) is secondary/excess only.

If your insurance:

  • Denies coverage

  • Is insufficient

You remain fully responsible.


9. Insurance Denial Clause

Insurance denial does NOT remove your liability.

You are responsible for:

  • Repairs

  • Total loss

  • Loss of use

  • Diminished value

  • Legal and administrative costs


10. Peer-to-Peer / Commercial Use Disclosure

You acknowledge:

  • This rental may be classified as peer-to-peer or commercial use

  • Your insurance may not cover this

You assume all risk of:

  • Coverage denial

  • Insufficient coverage


11. Vehicle Condition Verification

At rental start, you acknowledge:

  • The Vehicle was inspected

  • It is accepted in current condition unless documented

Any pre-existing damage must be:

  • Written AND

  • Supported with photo/video evidence

Failure to report damage = acceptance of condition.


12. Photo and Video Evidence

We may document the Vehicle using:

  • Photos

  • Videos

  • Telematics

  • Time-stamped inspections

These records are conclusive evidence.


13. Damage Presumption

Any damage found after return is presumed to have occurred during your rental unless you prove otherwise.


14. Cooperation with Claims

You must:

  • Cooperate with investigations

  • Provide documents and statements

  • Not misrepresent facts

Failure = breach of contract.


15. Personal Guarantee

Your financial responsibility:

  • Is independent of insurance

  • Survives claim denial or disputes


16. Additional Drivers

All drivers must:

  • Be listed in the Agreement

  • Provide valid license

  • Meet eligibility requirements

All drivers are jointly responsible.


17. Injury to Others

You are responsible for all third-party damages and injuries.

Any insurance we provide is:

  • Minimum required by law

  • Secondary to your coverage

Coverage is void if:

  • Agreement is breached

  • Unauthorized driver is used


18. Charges

You agree to pay:

  • Rental charges

  • Fuel charges

  • Tolls

  • Late fees (2% monthly)

  • Collection/legal costs

  • Cleaning fees (up to $350)

We may correct billing errors.


19. Deposit

Your deposit may be used to cover any charges.


20. Payment Methods

Accepted:

  • Visa

  • Mastercard

  • American Express

  • Discover

Cash or certified funds only if pre-approved.


21. Personal Property

We are not responsible for lost or damaged personal items.


22. Breach of Agreement

Violation of terms results in:

  • Immediate liability

  • Possible legal action


23. Extension of Rental

Extensions must be requested and approved.

Unapproved extensions = violation.


24. Miscellaneous

Failure to enforce any provision does not waive rights.

If any provision is invalid, remaining terms remain enforceable.


25. Cancellation Policy

  • 24+ hours notice: full refund

  • Less than 24 hours: e-credit only


26. SMS Communication

You agree to receive:

  • Notifications

  • Updates

  • Promotional messages

You may opt out at any time.
